Immigration and Refugee Appeal Services

Navigating Canada’s immigration and refugee processes can be overwhelming, especially when decisions don’t go in your favor. At IJ Paralegal Services, we assist clients with appeals to the Immigration Appeal Division (IAD) and the Refugee Appeal Division (RAD) of the Immigration and Refugee Board of Canada (IRB). Our mission is to provide professional and compassionate support throughout the appeals process.

Immigration Appeals before the IRB

The Immigration Appeal Division (IAD) hears and decides on various immigration-related appeals, including:

  • Sponsorship Appeals: If your application to sponsor a family member has been refused, you may appeal this decision to the IAD. We ensure your case is thoroughly reviewed and presented to maximize the chances of approval.

  • Removal Order Appeals: Permanent residents, protected persons, or foreign nationals with permanent resident visas who face removal orders can appeal to the IAD. Our team is skilled in representing clients and challenging removal orders effectively.

  • Residency Obligation Appeals: Permanent residents found to have failed their residency obligations can appeal to the IAD. We assist in demonstrating compliance or providing sufficient humanitarian and compassionate grounds to overturn the decision.

Refugee Appeals

The Refugee Appeal Division (RAD) provides a critical opportunity to appeal a negative refugee claim decision. We represent clients who seek protection in Canada and have had their initial claim denied by the Refugee Protection Division (RPD).

Key aspects of refugee appeals include:

  • Reviewing Decisions: The RAD reviews the decision of the RPD for errors in law, fact, or both. Our paralegals carefully analyze the original decision, identifying grounds for appeal and supporting your case.

  • New Evidence Submission: If applicable, we help you gather and submit new evidence that supports your claim and may have been unavailable during the initial decision.

  • Representation at Hearings: When necessary, we provide representation and present your case persuasively before the RAD.

  • Timely and Professional Guidance: Refugee appeals must be filed within strict deadlines. Our team ensures your appeal is prepared and submitted promptly, adhering to IRB requirements.

Our Comprehensive Services

For both Immigration and Refugee Appeals, we offer:

  • Case Evaluation: A thorough analysis of your situation to determine the feasibility of an appeal.

  • Document Preparation: Assistance with compiling all necessary documentation and meeting procedural requirements.

  • Legal Representation: advocacy during hearings and communication with the IAD or RAD.

  • Strategic Advice: Guidance on the strengths and weaknesses of your case to inform your decisions.
